CNE Vacation Rental Policies


TERM – This lease shall commence on, (arrival date) and shall continue until (departure date) (hereinafter “Term”), unless terminated at an earlier date in accordance with the terms and condition of this lease.


RENT – Guest agrees to pay CNE rent, plus Local Tax for the use and occupancy of the Premises in the amount listed on your Reservation Confirmation provided to you by CNE. All monies due shall be paid to CNE as per the terms on your Confirmation and must be paid in full 30 days prior to arrival. Delayed payment can result in the loss of your property reservation.


ASSOCIATION REGULATION – This agreement is subject to approval requirements of any Property Association (when applicable) of which the owner is a member. If the Association does not accept the Guest, this Agreement shall be cancelled and all rental monies shall be refunded. The Guest agrees to any Association regulations and to pay any rental approval fee including golf and social transfer fee and/or vehicle bar code sticker. Should Guest return an incomplete application a $25.00 fee will be charged to obtain completed Association application.


LIMITATIONS: Premises shall be used for recreational purposes only in a non-offensive manner. No use shall be made thereof which is unlawful, improper, noisy, or offensive, or contrary to the bylaws of the Briarwood homeowners association, the State of Florida Laws and ordinances, or of local town ordinances. No large gatherings for games of chance, clubs, or other organizations for activities open to the public, no campfires may be kindled, no tents, trailers, campers, motor homes, nor mobile homes, will be allowed on the premises. We ask that you keep the music and excess noise down to a minimum after 10p.m. and remind you absolutely No parties are permitted for any reason. Any guest violating the rules will be subject to forfeiture of advance payment, deposit and/or rental money, and will be evicted. Upon expiration of the rental period, tenants agree to give peaceable possession of the said premises to CNE Vacation Rental in as good a condition as they now are, usual wear accepted.


RESPONSIBLE PARTY – The person in whose Name the reservation is made will be held responsible for all occupants complying with rental policies, procedures and restrictions. We do not rent to anyone under the age of 25 (legal photo ID required upon request). Any reservation made under false pretenses will be subject to forfeiture of advance payment, deposit and/or rental money. Violators will be evicted.


WHAT TO BRING – All units are fully furnished for normal housekeeping. You need to provide your own toiletries, bath soap, dish soap, and laundry detergent.


ARRIVAL – Check- in time is after 4:00p.m. This time has been scheduled so that we can have the property properly cleaned and inspected for the arriving guest. Guests are not permitted to arrive prior to 4PM without prior written permission. Without prior consent, early occupancy will be subject to one extra day’s rental charged to the Credit Card on file. All efforts will be made to have your vacation home cleaned and ready by check-in time, but sometimes we cannot guarantee the exact time of occupancy due to unforeseen circumstances. Please notify your rental agent within 24 hours of any missing key’s, garage door openers, or damages noticed by you upon arrival.


HOUSEKEEPING: Your unit will be thoroughly cleaned before your arrival. If you are not satisfied with the condition upon check-in, please contact our office immediately and CNE will dispatch a housekeeping representative. If you are a late arrival, please notify us by the following morning. If you have not called within 24 hours of your arrival, we will assume you found your unit in acceptable condition.


DEPARTURE – Check Out – Tenants must vacate the property on the last day of tenancy before 10:00a.m. Any changes to this time must have written permission from CNE prior to departure. Without prior consent, late checkouts will be subject to one extra day’s rental charged to the Credit Card on file. This provision shall not be construed to permit the Tenant to stay an additional night or stay beyond the check- out time. Close and lock all windows and sliding glass doors before you leave. LEAVE BEDS UN-MADE if used; last day’s BATH towels only= 1 towel per max guests allowed in property. Dinnerware and silverware should be cleaned and placed where found. PLEASE remove all food from cabinets and refrigerator. All trash must be removed from the unit in properly sealed garbage bags and placed in “Large green waste container” or Condo Dumpster. Excessive laundry, garbage, or loose items in garbage cans will result in additional fees. Place the keys and garage door opener where you found them upon arrival (there is a $20 charge for lost keys and $100 charge for lost garage door openers.)


NO SMOKING – NO smoking in the units. You are welcome to smoke outside each unit, provided you dispose of your “butts” appropriately! You will be charged a $1000 fee to bring the unit back to non-smoking standards.


TRASH – Large green waste containers are located at each unit. Trash pick-up is listed in the information book provided at each accommodation. Single Family homes Containers are on wheels and must be place at the foot of the driveway for pick – up the evening prior to collection day. If you depart on garbage collection day, gather all trash the evening before departure in sealed garbage bags and place curbside for pick up, loose items in cans will result in additional fees being charged. If you miss a trash or Recycle day, you will be charged an additional fee to remove excessive trash from the property. Garbage comes twice a week, recycling once. Although we all like to Recycle, if there is not a collection day prior to your departure, place all recycling in the garbage container for disposal on the next trash day. Fines are charged when cans are left outside of collection hours.


PETS – In some cases the homes allow pets, you must let CNE know if a pet will be with you, upon approval of your pet an additional pet fee will be required. If a pet is found on property without approval you will be removed from the property.


CANCELLATIONS – If you are forced to cancel your trip a $500 fee will be withheld by the property manager. After that, the following refunds apply: 100 % if CNE Vacation Rental received written notice of termination at least 120 days before the arrival date. 70% if canceled at least 90 days before arrival date, all monies collected shall be forfeited if canceled 89 days or less prior to your arrival.


SECURITY DEPOSIT – You must provide CNE Vacation Rental with a valid Master Card, Visa, or Discover card to secure against damages to the property during your stay.


REPAIRS – Please notify your rental agent in writing within 24 hours of any damages noticed by you upon arrival. All equipment in the unit should be in working order. Every effort will be made to rectify the problem ASAP, but we cannot refund your money due to mechanical failure.


WI-FI Internet – The wireless Internet is password protected, passwords are listed on your Driving Directions and located in the Front of the property information booklet at the property


AVAILABILITY – Right to Change Rental Accommodations (Substitution): We reserve the right to substitute comparable accommodations without prior notice or liability in the event of a sale of the rental property, or if the property becomes unavailable due to maintenance or other problems. We cannot absolutely guarantee a specific rental property in the event of unforeseen circumstances which could render the property to be unsafe or uninhabitable. We will make every effort to contact you should this happen. When comparable accommodations are not available, guests will have the option of selecting from available properties at the comparable published rate or receiving a complete refund.


RIGHT TO ENTER – Owner or Agent shall have the right to enter the premises for inspection, maintenance, and repair during reasonable hours, or as provided otherwise by the laws of the State of Florida.


ADDITIONAL REGULATIONS – Guest shall not sublet nor assign this agreement and abide by the Maximum Occupancy: The maximum number of guests per unit is based on the individual unit’s ability to comfortably and safely accommodate our guests. Occupancy limits are in accordance with rules of the State Fire Marshal’s Office. No exceptions will be made. Guest exceeding maximum occupancy will be subject to forfeiture of advance payment, deposit and/or rental money, and will be evicted.


INDEMNIFICATION – The Guest(s) agrees to and does hereby indemnify and hold harmless the agent, agent’s employees and representatives, and the home (premises) owner, his representatives, successors and assigns from any and all claims, liability, and injury to person or persons upon the premises from any cause whatsoever. This full indemnification includes and is not limited to any and all suits, injury, costs, losses, actions, court costs, attorney fees, penalties and damages of any kind, however caused, (except willful gross negligence) and any expenses arising from or related thereto, from the Guest’s rental use and enjoyment of the premises.


SOLE AGREEMENT – This document, including any attachments incorporated by reference herein, constitutes the entire and sole agreement between CNE and Guest respecting the leased Premises, the leasing of the leased Premises to Guest, and the lease term created under this Lease, and correctly sets forth the obligations of CNE and Guest to each other as of its date. Any agreements or representations respecting the leased premises or their leasing by CNE to Guest not expressly set forth in the lease agreement are null and void.
